4. Fees And Payment

We accept various methods of payment including debit/credit cards and third-party providers such as Venmo. We may offer other payment options in certain locations. You may be required to pay a fee to access some of our services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via our website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing service for purchases made via our website. Sales, use or similar taxes will be added to the price of purchases where we determine it is applicable – the total price including applicable taxes will be shown at check-out before you complete your purchase. We may change our prices at any time. All payments shall be in the currency indicated on the payment page.

You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase. If your purchase is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation.

For certain products or services, we offer a payment plan option that allows you to receive the product or service upfront, in exchange for future payments. Failure to make future payments as agreed may result in reporting of your information to credit bureaus or similar credit reporting entities and appearing on your credit report.

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through our website.

5. Service Expiration

All services purchased must be redeemed with 120 days of purchasing the service. For resume writing services, if you do not schedule and complete your consultation with our consultant within 120 days of purchase, your purchased services will be considered void and no-refunds will be given. Should you fail to contact your resume writer or our representative within 120 days of ordering the service, your order will be marked as “completed” and no refund will be given.

6. Cancellation, Refunds, And Guarantees

• We provide career coaching and talent acquisition consultancy services. All sales are final. There is no trial or grace period after purchasing any service. We will work with you throughout the project’s period until you are satisfied with your services. As a result, there are no refunds once the service has been purchased. Any exceptions to this policy are the sole and absolute discretion of TalentbySP LLC.

• Our guarantees: if you have not received a phone screen or job interview request within 90 days of receiving your final copy, we will rewrite your resume one time free of charge, provided that you notify us in writing within ninety days (90) of receiving your final copy. 

The terms of the guarantee:

• You must have sent our final, customized resume to at least 30 companies.
• Your request must be submitted in writing to [email protected] within 90 days of receiving your final resume.
• You must include 3 examples of job descriptions to which you have applied and any revisions you have made to your resume from the final version we delivered. 

• The guarantee is limited to resumes and does not include additional services, such as cover letters, coaching and/or consulting services.

7. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need your personal information, we will securely dispose of it.

TO THE MAXIMUM EXTENT ALLOWED BY LAW, YOU AGREE THAT NEITHER THE COMPANY NOR ANY OF THE COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, PARTNERS AND/OR SUPPLIERS WILL BE LIABLE TO YOU AND/OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR INCIDENTAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF PRIVACY OR FOR FAILURE TO MEET ANY DUTY, INCLUDING, BUT NOT LIMITED TO, ANY DUTY OF GOOD FAITH, LACK OF NEGLIGENCE OR OF WORKMANLIKE EFFORT) WHATSOEVER THAT MAY ARISE OUT OF OR BE RELATED TO THE SITE, SERVICES, AND/OR MATERIALS AND/OR ANY RELATED INFORMATION, OR TO ANY BREACH OF THESE TERMS, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE) OR STRICT OR PRODUCT LIABILITY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE COMPANY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
